THE SMALL BUSINESS REORGANIZATION ACT (SBRA)
Effective February 19, 2020, Congress passed The Small Business Reorganization Act (SBRA). Called Subchapter 5 of Chapter 11 of the United States Bankruptcy Code, this new provision is for businesses with debt low 2.7 million dollars (this was recently increased to 7.5 million dollars through March of 2021 in light of the Coronavirus). This new subchapter is designed to make the reorganization process faster and less expensive for small businesses who wish to utilize Chapter 11 of the Bankruptcy Code. The SBRA will lower costs and streamline the reorganization process to better enable small businesses to survive bankruptcy and retain control of its operations.
